Deprivation of Liberty Safeguarding (DoLs) Suspension Request - Form 7

The Mental Capacity Act 2005 covering England and Wales, provides a statutory framework for acting and making decisions on behalf of people who lack the capacity to make decisions for themselves. These can be small decisions such as what clothes to wear or major decisions such as where to live. It is recognised that there are times when the measures put in place will restrict a person's movements, albeit in their best interests and proportionate to the risk of harm, to a point where they may become deprived of their liberty.

There are two routes to authorise any deprivation of liberty in a care setting.

Standard authorisation through the Deprivation of Liberty Safeguards - a deprivation of a person's liberty whilst accommodated in a care home or hospital can be authorised by ‘Supervisory Bodies', roles assumed by local authorities. In order to obtain authorisation to deprive a person of their liberty, ‘Managing Authorities' (care homes and hospitals) are responsible for applying for an authorisation. They can do this by completing the necessary forms via our B&NES Adult's Portal.

B&NES DoLs Team process:

You will receive a submitted form notification from this portal to your registered email address confirming we have received your Form 1.

DoLs Team will triage each referral and be in contact with you to discuss the process and give advice.

The above person no longer meets the eligibility requirement for a Standard Authorisation under Schedule A1 to the Mental Capacity Act 2005.

The Standard Authorisation is suspended from the time this notice is given.
 
 The Standard Authorisation no longer authorises the care home or hospital to deprive the person of their liberty for as long as it is suspended.
